Acceptance of Terms By accessing and using the Sibyl AI chat application (“the Service”), you are agreeing to be bound by these Terms and Conditions (“Terms”). These Terms apply to all users who access or use the Service, and constitute a legally binding agreement between you and Spiritech Inc. (“Spiritech,” “we,” “us,” or “our”). If you do not agree to these Terms, you must not access or use the Service.
License to Use the Service Subject to your compliance with these Terms, Spiritech grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial purposes. Any other use of the Service is strictly prohibited.
User Conduct You agree not to use the Service to transmit any information or material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable. You further agree not to transmit any unsolicited or unauthorized advertising, promotional materials, or any other form of solicitation.Privacy and Data Usage By using the Service, you acknowledge and agree that your chat conversations may be monitored or reviewed by Spiritech and its authorized representatives for quality control purposes. You agree not to share any sensitive or private information, including but not limited to personal identification information, financial information, or medical records, within the chat. Spiritech is not responsible for any unauthorized access to or disclosure of any information you provide through the Service.
- No Liability for User-Generated Content Sibyl AI is an artificial intelligence chatbot and the information provided through the Service should not be considered factual, professional, or expert advice. Spiritech, its affiliates, and subsidiaries disclaim any liability for any actions taken or not taken based on the information provided by the Service. You are solely responsible for your reliance on the information obtained through the Service and for any consequences resulting from such reliance.
- Limitation of Liability By using the Service, you agree to release Spiritech, its affiliates, and subsidiaries from any liability related to the use of the chat and the information provided by Sibyl AI. In no event shall Spiritech, its affiliates, subsidiaries, or their respective directors, officers, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or other damages arising out of or in connection with the use, inability to use, or performance of the Service, even if Spiritech has been advised of the possibility of such damages.
- Indemnification You agree to defend, indemnify, and hold harmless Spiritech, its affiliates, subsidiaries, and their respective directors, officers, employees, and agents from and against any and all claims, actions, demands, damages, costs, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your infringement of any third party rights, including intellectual property rights.
- Intellectual Property
- All intellectual property rights in and to the Service, including but not limited to copyright, trademark, and trade secret rights, are owned by Spiritech or its licensors. You agree not to copy, modify, create derivative works of, publicly display, publicly perform, or otherwise exploit any part of the Service without the express written permission of Spiritech.
- Modification of Terms
- Spiritech reserves the right to modify these Terms at any time and at its sole discretion. If we make material changes to these Terms, we will notify you through the Service or by other appropriate means. Your continued use of the Service after any such modifications constitutes your acceptance of the new Terms. It is your responsibility to periodically review these Terms for any changes.
- Termination
- Spiritech may, at its sole discretion, suspend or terminate your access to the Service, without notice or liability, for any reason, including but not limited to violation of these Terms. Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including but not limited to limitations of liability, indemnification, and intellectual property rights.
- Governing Law and Jurisdiction
- These Terms and any disputes arising out of or relating to the Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Spiritech is incorporated, without regard to its conflict of law
- provisions. You agree to submit to the exclusive jurisdiction of the courts located within that jurisdiction for the resolution of any disputes arising out of or in connection with these Terms or the Service.
- Severability
- If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to render it valid and enforceable.
- No Waiver
- No waiver of any provision of these Terms by Spiritech shall be deemed a further or continuing waiver of such provision or any other provision, and Spiritech’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
- Entire Agreement
- These Terms constitute the entire agreement between you and Spiritech regarding the use of the Service and supersede any prior agreements, understandings, or representations, whether written or oral, relating to the Service. No modification or amendment to these Terms shall be binding upon Spiritech unless in writing and signed by an authorized representative of Spiritech.
- By using the Sibyl AI chat application, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you must immediately cease your use of the Service.
